Answer: It is obligatory to pay the Khums to the owner of the Khums, who is the one in charge of the affairs of the Muslims, unless the opinion of the scholar of independent law-making (Mujtahid) whom he imitates does not agree with it.” [Ajwibat-ul-Istifta’at, Volume 1 Page 302]
