Yahya Ibn Sharaf An-Nawawi writes: ,,As for the marriage time and penetration of the little married girl – if the husband and guardian agree, that nothing will happen to the little girl – then it can be done and if they disagree, Ahmad Ibn Hanbal and Abu Ubaid say, that you force the girl at the age of nine years, without the other. Malik ibn Anas, Muhammad ibn Idris Ash-Shafi’ and Abu Hanifah say that the limit is that she can bear sexual intercourse and the different opinions about it arise from its disagreements, but age does not matter and that is the correct view.” [Sharh Sahih Muslim, Vol. 9 page 206]

قال يحيى بن شرف النووي: وأما وقت زفاف الصغيرة المزوجة والدخول بها فإن اتفق الزوج والولي على شيء لا ضرر فيه على الصغيرة عمل به وإن اختلفا فقال أحمد وأبو عبيد تجبر على ذلك بنت تسع سنين دون غيرها وقال مالك والشافعي وأبو حنيفة حد ذلك أن تطيق الجماع ويختلف ذلك باختلافهن ولا يضبط بسن وهذا هو الصحيح
