Question:

Some innovators claim that the Imam (a.) rules with the legislation (شريعة) of David (a.). The primary source cited is the 1st volume of Al-Kafi on page 397. What are the actual reports we have?

[ 1. ] David was not a legislative prophet:

Sama’ah Ibn Mihran reported that he asked Imam Ja’far As-Sadiq (a.) about the word of God: “Be patient now, just as those of the Messengers who had determination were patient.” – 46:35 – He said: “These are Noah, Abraham, Moses, Jesus and Muhammad (s.).” I said: “How did they become the owners of determination?” He said: “By sending Noah (a.) with a book and legislation and everyone who came after Noah (a.) followed the book, legislation and the path of Noah (a.) until Abraham (a.) appeared with the scriptures and the determination to abrogate the book of Noah (a.) without committing disbelief in it. Thereupon, every prophet who came after Abraham (a.) followed the legislation, the path, and the writings of Abraham (a.) until Moses (a.) appeared with the Torah, his legislation, his path and the decision to abrogate the scriptures. Every prophet who came after Moses (a.) followed the Torah, its legislation and its path until the Messiah (a.) appeared with the Gospel and the decision to abrogate the legislation and the path of Moses (a.). Thereupon, every prophet who came after the Messiah (a.) followed his legislation and path until Muhammad (s.) appeared with the Qur’an, his legislation and path. Therefore, what he declared permissible is permissible until the Day of Resurrection and what he declared forbidden is forbidden until the Day of Resurrection. These are the owners of the determination among the Messengers (s.).” [Al-Kafi of Al-Kulaini, Volume 2 page 17 – 18 Hadith 2]

عدة من أصحابنا، عن أحمد بن محمد بن خالد، عن عثمان بن عيسى، عن سماعة ابن مهران قال: قلت لأبي عبد الله عليه السلام قول الله عز وجل: فاصبر كما صبر أولو العزم من الرسل فقال: نوح وإبراهيم وموسى وعيسى ومحمد صلى الله عليه وآله وعليهم، قلت: كيف صاروا اولي العزم؟ قال: لان نوحا بعث بكتاب وشريعة، وكل من جاء بعد نوح أخذ بكتاب نوح وشريعته ومنهاجه، حتى جاء إبراهيم عليه السلام بالصحف وبعزيمة ترك كتاب نوح لا كفرا به فكل نبي جاء بعد إبراهيم عليه السلام أخذ بشريعة إبراهيم و منهاجه وبالصحف حتى جاء موسى بالتوراة وشريعته ومنهاجه، وبعزيمة ترك الصحف وكل نبي جاء بعد موسى عليه السلام أخذ بالتوراة وشريعته ومنهاجه حتى جاء المسيح عليه السلام بالإنجيل، وبعزيمة ترك شريعة موسى ومنهاجه فكل نبي جاء بعد المسيح أخذ بشريعته ومنهاجه، حتى جاء محمد صلى الله عليه وآله فجاء بالقرآن وبشريعته ومنهاجه فحلاله حلال إلى يوم القيامة وحرامه حرام إلى يوم القيامة، فهؤلاء أولو العزم من الرسل عليهم السلام

[ 2. ] The legislation (شريعة) will remain until the Last Day:

Zurarah reported, that he asked Imam Ja’far As-Sadiq (a.) about what is permitted and what is forbidden and got the answer: “What is permitted by Muhammad (s.) remains permitted until the Day of Resurrection and what is forbidden by Muhammad (s.) remains forbidden until the Day of Resurrection. There is no one but him and no one meets it except for him.” Ja’far As-Sadiq (a.) reported that Imam Ali (a.) said: “No one establishes an innovation, except that by doing so he abrogates a Sunnah.” [Al-Kafi of Al-Kulaini, Volume 1 page 58 Hadith 19]

علي بن إبراهيم، عن محمد بن عيسى بن عبيد، عن يونس، عن حريز عن زرارة قال: سألت أبا عبد الله عليه السلام عن الحلال والحرام فقال: حلال محمد حلال أبدا إلى يوم القيامة، وحرامه حرام أبدا إلى يوم القيامة، لا يكون غيره ولا يجئ غيره، وقال: قال علي عليه السلام: ما أحد ابتدع بدعة إلا ترك بها سنة

[ 3. ] It is about judgment (حكم), not about legislation (شريعة):

Ammar As-Sabati reported that he asked Imam Ja’far As-Sadiq (a.): “In which position are the Imams?” He said: “The position is like that of Dhu-l-Qarnain, Joshua and Asaf, the companion of Solomon (a.).” He asked: “In what way do you judge?” He said: “With the way of judging of God, the way of judging of the family of David and the way of judging of Muhammad (s.) and the Holy Spirit enlightens us with it.” [Al-Kafi of Al-Kulaini, Volume 1 page 398 Hadith 5]

أحمد بن مهران رحمه الله، عن محمد بن علي، عن ابن محبوب، عن هشام بن سالم، عن عمار الساباطي قال: قلت لأبي عبد الله عليه السلام: ما منزلة الأئمة؟ قال: كمنزلة ذي القرنين وكمنزلة يوشع وكمنزلة آصف صاحب سليمان، قال: فبما تحكمون؟ قال: بحكم الله وحكم آل داود وحكم محمد صلى الله عليه وآله ويتلقانا به روح القدس

Ammar As-Sabati reported that he asked Imam Ja’far As-Sadiq (a.): “In what way do you judge, when you make a judgment?” He said: “With the way of judging of God and the way of judging of David (a.), because when we encounter a matter, about which nothing is with us, the Holy Spirit enlightens us with it.” [Al-Kafi of Al-Kulaini, Volume 1 page 398 Hadith 3]

محمد، عن أحمد بن محمد، عن ابن محبوب، عن هشام بن سالم، عن عمار الساباطي قال: قلت لأبي عبد الله عليه السلام: بما تحكمون إذا حكمتم؟ قال: بحكم الله وحكم داود فإذا ورد علينا الشئ الذي ليس عندنا، تلقانا به روح القدس

Ju’aid Al-Hamdani reported that he asked Imam Zain-ul-Abidin (a.): “In what way do you judge?” He said: “With the way of judging of the family of David (a.), for when something causes us difficulty, the Holy Spirit enlightens us with it.” [Al-Kafi of Al-Kulaini, Volume 1 page 398 Hadith 4]

محمد بن أحمد، عن محمد بن خالد، عن النضر بن سويد، عن يحيى الحلبي، عن عمران بن أعين، عن جعيد الهمداني، عن علي بن الحسين عليهما السلام، قال: سألته بأي حكم تحكمون؟ قال: حكم آل داود، فإن أعيانا شئ تلقانا به روح القدس

Asbat reported that he asked Imam Ja’far As-Sadiq (a.): “Are you asked about a matter about which you have no knowledge?” He said: “Sometimes this may be the case.” I said: “How do you proceed then?” He said: “The Holy Spirit enlightens us with it.” [Basa’ir-ud-Darajat of As-Saffar, page 471 Hadith 4]

حدثنا أحمد بن محمد عن البرقي عن أبي الجهم عن أسباط عن أبي عبد الله عليه السلام قال قلت تسئلون عن الشئ فلا يكون عندكم علمه قال ربما كان ذلك قلت كيف تصنعون قال تلقانا به روح القدس

Humran ibn A’yan reported that he asked Imam Ja’far As-Sadiq (a.): “In which way do you judge?” He said: “We judge with the way of judging of the family of David (a.).” [Basa’ir-ud-Darajat of As-Saffar, page 278 Hadith 2]

عن محمد بن الحسين عن صفوان بن يحيى عن أبي خالد القماط عن حمران بن أعين عن أبي عبد الله عليه السلام قال: قلت فبما تحكمون قال نحكم بحكم آل داود

Al-Hasan Ibn Zarif reported that Imam Al-Hasan Al-Askari (a.) said: “You asked me about the one who rises (Qaim ajf). When he rises, he judges between people according to his knowledge in the same way as David (a.) judged. He does not ask for a clear proof.” [Al-Kafi of Al-Kulaini, Volume 1 page 509 Hadith 13]

عن إسحاق عن الحسن بن ظريف عن أبي محمد العسكري عليه السلام أنه قال: سألت عن القائم فإذا قام قضى بين الناس بعلمه كقضاء داود عليه السلام لا يسال البينة

Abu Ubaidah Al-Hadhdha’ reported that Imam Muhammad Al-Baqir (a.) said: “O Abu Ubaidah, when the Riser (Qaim ajf) from the family of Muhammad (a.) rises, he judges with the way of judging of David (a.) and Solomon (a.). He does not ask for a clear proof.” [Al-Kafi of Al-Kulaini, Volume 1 page 397 Hadith 1]

عن علي بن إبراهيم عن أبيه عن ابن أبي عمير، عن منصور عن فضل الأعور عن أبي عبيدة الحذاء عن ابي جعفر عليه السلام أنه قال: يا أبا عبيدة إذا قام قائم آل محمد عليه السلام حكم بحكم داود وسليمان لا يسأل بينة

Abu Ubaidah reported that Imam Ja’far As-Sadiq (a.) said: “When the Riser (Qaim ajf) from the family of Muhammad (a.) rises, he judges with the way of judging of David (a.) and Solomon (a.). He does not ask for a clear proof.” [Basa’ir-ud-Darajat of As-Saffar, page 279 Hadith 3]

حدثنا محمد بن عيسى عن محمد بن إسماعيل عن منصور بن يونس عن فضيل الأعور عن أبي عبيدة عنه عليه السلام قال إذا قام قائم آل محمد حكم بحكم داود وسليمان لا يسئل الناس بينة

Hariz reported that Imam Ja’far As-Sadiq (a.) said: “This world will not perish until a man from us, the people of the House will appear, who will judge with the way of judging of David (a.) and he will not ask the people for a clear proof.” [Basa’ir-ud-Darajat of As-Saffar, page 279 Hadith 4]

حدثنا عبد الله بن جعفر عن محمد بن عيسى عن يونس عن حريز قال سمعت أبا عبد الله عليه السلام يقول لن تذهب الدنيا حتى يخرج رجل منا أهل البيت يحكم بحكم داود ولا يسئل الناس بينة

Aban reported that Imam Ja’far As-Sadiq (a.) said: “This world will not perish until there will be a man brought forth from me, who will judge with the way of judging of the family of David (a.) and he does not ask for a clear proof. He gives every soul its right.” [Al-Kafi of Al-Kulaini, Volume 1 page 397 – 398 Hadith 2]
