Question:

What role does mental maturity play in temporary marriage?

Answer:

Jamil Ibn Darraj reported that he asked Imam As-Sadiq (a.):
“Does one enter into a temporary partnership with an virgin female person?” He said: “There is no problem with that, as long as she is not considered too young.” Ibn Abi Umair reported that a man asked Imam As-Sadiq (a.): “At what age is a young girl no longer a child? At six or seven?” He said: “No, she is not a child at nine years of age, and all are united in the fact that she is not a child at nine years of age, unless she is still weak in her reasoning, but if she is not, and she is nine years old, then she has become an adult.” Muhammad Ibn Hashim reported that Imam Al-Kazim (a.) said: “If an virgin female person entered into a partnership, then she is not in a trickable state.” Ibrahim Ibn Muhriz Al-Khath’ami reported that Muhammad Ibn Muslim said: “I asked him about a girl: “Do you enter into a temporary partnership with her?” He said: “Yes, unless she is a child who can be tricked.” I said: “May God grant you salvation, to what limit does she have to mature, so that she is no longer a child that can be tricked? He said:”An age of ten years.” [Wasa’il-ush-Shi’ah by Al-Hurr Al-Amili, volume 21 page. 36-37]
