May one marry a women, who is not divorced according to the custom (Sunnah) of the Prophet?

Shu’aib Al-Haddad reported that he asked Imam As-Sadiq (a.): “One of your close ones has sent you the greeting of peace. He wanted to take a woman as his partner who was suitable for him and in whom he liked so many things, but she had a partner who divorced her three times in contradiction to the custom (Sunnah) and he was reluctant to take her as his partner before asking you for instructions so that you may give him an order.” He said: “It is about the private part and those things, which are related to the private part are grave and from it springs the progeny and we take precaution (Ihtiyat), so he does not take her as a partner.” [Al-Kafi of Al-Kulaini, Vol. 5, page 424, Hadith 2]

عدة من أصحابنا، عن أحمد بن محمد بن عيسى، عن الحسين بن سعيد، عن النضر ابن سويد، عن محمد بن أبي حمزة، عن شعيب الحداد قال: قلت لابي عبد الله عليه السلام: رجل من مواليك يقرئك السلام وقد أراد أن يتزوج امرأة قد وافقته وأعجبه بعض شأنها وقد كان لها زوج فطلقها ثلاثا على غير السنة وقد كره أن يقدم على تزويجها حتى يستأمرك فتكون أنت تأمره؟ فقال أبو عبد الله عليه السلام: هو الفرج وأمر الفرج شديد ومنه يكون الولد ونحن نحتاط فلا يتزوجها

Ali Ibn Hamzah reported that he asked Imam Al-Kazim (a.): “What about a woman who has not been divorced according to the custom (Sunnah)? Do you take her as a partner?” He said: “Bind them to what they bind themselves to and take the women as partners, for there is no problem in that.” Al-Hasan reported that Ja’far ibn Sama’ah was asked: “What about a woman who has not been divorced according to the custom (Sunnah)? Is it my right to take her as my partner?” He said: “Yes.” I asked him: “Do you not know that Ali Ibn Hanzalah narrated the tradition: “Beware of women who have been divorced three times at once (triple talaq), for they are still in partnership?” He said: “O my son, the tradition of Ali Ibn Abi Hamzah gave leeway with regard to people.” I asked: “What did Ali Ibn Abi Hamzah narrate?” He said: “He reported that Musa Al-Kazim (a.) said: “Bind them to what they bind themselves to and take the women as partners, for there is no problem in that.” [At-Tahdhib of At-Tusi, Volume 8, Page 58, Hadith 109]

وعنه عن عبد الله بن جبلة قال: حدثني غير واحد من اصحاب علي بن ابي حمزة عن علي بن ابي حمزة انه سأل ابا الحسن عليه السلام عن المطلقة على غير السنة أيتزوجها الرجل ؟ فقال: الزموهم من ذلك ما الزموه انفسهم وتزوجوهن فلا باس بذلك، قال الحسن: وسمعت جعفر بن سماعة وسئل عن امرأة طلقت على غير السنة ألي ان اتزوجها ؟ فقال: نعم فقلت له أليس تعلم ان علي بن حنظلة روى اياكم والمطلقات ثلاثا على غير السنة فانهن ذوات أزواج ؟ فقال: يا بني رواية علي ابن ابي حمزة اوسع على الناس، قلت: وأي شئ روى علي بن ابي حمزة ؟ قال: روى عن ابي الحسن عليه السلام انه قال: الزموهم من ذلك ما الزموه انفسهم وتزوجوهن فانه لا باس بذلك

Ja’far ibn Muhammad reported that Muhammad ibn Ubaidllah said: “I asked Ali Ar-Rida (a.) about the women who were divorced three times at once, to which he replied: “Your divorcees are not allowed (halal) for the others, whereas their divorcees are allowed (halal) for you, because you consider three divorces at once invalid, whereas they are committed to this.” [At-Tahdhib of At-Tusi, Volume 8, Page 59, Hadith 112]

محمد بن أحمد بن يحيى الاشعري عن أحمد بن محمد عن جعفر بن محمد بن عبيد الله عن ابيه قال: سألت ابا الحسن الرضا عليه السلام عن تزويج المطلقات ثلاثا فقال لي: ان طلاقكم لا يحل لغيركم وطلاقهم يحل لكم لا نكم لا ترون الثلاث شيئا وهم يوجبونها

Abdullah ibn Tawus reported that he asked Imam Ar-Rida (a.): “I have a nephew whose partner is my daughter. He is a drunkard and frequently mentions about divorce.” He said: “If he is one of your brothers, then nothing is obligatory on him, but if he is one of these people, then detach her from him.” By which he meant separation and I said: “May my life be sacrificed to you, is it not narrated from Ja’far As-Sadiq (a.) that he said: “Beware of the women who have been divorced three times at once, for they are still in partnership?” He said: “That is true for your brothers, but not for these people, for whoever bound himself to the religion of people, he is bound by their rulings.” [Al-Ma’ani of As-Saduq, page 263, Hadith 1]

حدثنا أبي – رحمه الله – قال: حدثنا الحسين بن أحمد المالكي، قال: حدثنا عبد الله بن طاووس سنة إحدى وأربعين ومائتين قال: قلت لأبي الحسن الرضا عليه السلام: إن لي ابن أخ زوجته ابنتي وهو يشرب الشراب ويكثر ذكر الطلاق. فقال: إذا كان من إخوانك فلا شئ عليه وإن كان من هؤلاء فأبنها منه. – فإنه عنى الفراق – قال: قلت: جعلت فداك أليس روي عن أبي عبد الله عليه السلام أنه قال: إياكم والمطلقات ثلاثا في مجلس واحد فإنهن ذوات أزواج، فقال: ذاك من إخوانكم لا من هؤلاء لأنه من دان بدين قوم لزمته أحكامهم 

Abu Abbas Al-Baqbaq reported that Imam As-Sadiq (a.) said: “Narrate from me that the woman is separated from him who divorced her three times at once.” [At-Tahdhib of At-Tusi, Volume 8, Page 59, Hadith 111]

وعنه عن معاوية بن حكيم عن ابي مالك الحضرمي عن ابي العباس البقباق قال: دخلت على ابي عبد الله عليه السلام قال: فقال لي: ارو عنى أن من طلق امرأته ثلاثا في مجلس واحد فقد بانت منه

Muhammad Al-Baqir (a.) reported that Imam Ali (a.) said: “If a man divorced a woman three times at once, then she is separated from him and there is neither inheritance between them nor any withdrawal and she is not allowed (Halal) to him until she unites with another partner, but if he said: “She is divorced, she is divorced, she is divorced.” Then she is divorced from him by the first statement and then he is among the suitors (for partnership). If she wished, she entered into a new covenant with him for the union (Nikah) and if she wished, she would not.” [Al-Istibsar of At-Tusi, vol. 3, page 287, hadith 8]

عنه عن الحسن بن موسى الخشاب عن غياث بن كلوب بن فيهس البجلي عن إسحاق بن عمار الصيرفي عن جعفر عن أبيه أن عليا عليه السلام كان يقول إذا طلق الرجل المرأة قبل أن يدخل بها ثلاثا في كلمة واحدة فقد بانت منه ولا ميراث بينهما ولا رجعة ولا تحل له حتى تنكح زوجا غيره، وإن قال: هي طالق هي طالق هي طالق فقد بانت منه بالأولى وهو خاطب من الخطاب إن شاءت نكحته نكاحا جديدا وإن شاءت لم تفعل
